IMPORTANT: ALL USERS MUST READ THESE TERMS AND CONDITIONS
Buyatab Online Inc ("Buyatab.com") is a website service that sells Tabs
("Tabs") available to anyone who visits
www.buyatab.com ("User" or "users"). Tabs are pre paid coupons
for specific Merchants ("Registered Merchants") that are bought by consumers and
companies for delivery to other consumers or companies ("Recipient"). Tabs may
be sold in two forms - Electronic Tabs ("E-Tabs") and Plastic Tabs. E-Tabs are
emailed to the recipient, mailed to the recipient or self printed. Plastic Tabs,
which take the form of a standard gift card, are mailed through the Registered
Merchant to the recipient.
User is not required to create an account in order to purchase any product from
Buyatab.com. However, Buyatab.com recommends this so Buyatab.com can provide
User with easy access to print orders, view past purchases, and modify
preferences.
User privacy is important to us and Buyatab.com wants to protect it. Buyatab.com
will not share User’s personal information with anyone other than those listed
in Buyatab.com’s Privacy Policy.
Acceptance of Terms and General
By using Buyatab.com, users agree to these Terms and Conditions ("Terms"). These
Terms constitute an agreement between Buyatab.com and User, that applies to use
of this Site by User. By using this Site (other than to read this Agreement for
the first time), User agrees to comply with all of the terms hereof. By placing
any order for Tabs, User offers to purchase products selected by User based on
these
Terms.
Buyatab.com reserves the right at all times to discontinue or modify these Terms
and/or Buyatab.com’s Privacy Policy as Buyatab.com deems necessary or desirable
without notification to Users. Such changes may include, among other things, the
adding of fees or charges. User agrees to re-read the Terms and Privacy Policy
from time to time in order to stay informed as to any such changes. If
Buyatab.com makes changes to Buyatab.com’s Terms and / or Privacy Policy and
User continues to use Buyatab.com’s Site, User agrees to the Terms and Privacy
Policy expressed herein. Any such deletions or modifications shall be effective
immediately upon Buyatab.com's posting thereof. Any use of Buyatab.com by User
after such notice shall be deemed to constitute acceptance by User of such
modifications. These provisions will survive termination of this agreement.
As a condition of selling anything to User, Buyatab.com requires User’s
permission to send User administrative and promotional emails. Buyatab.com will
send User information regarding User’s account activity and purchases as well as
updates about Buyatab.com’s products and promotional offers.
Description
Buyatab.com provides an online service operated by Buyatab.com on the World Wide
Web of the Internet (the "Web"), consisting of information services, content and
transaction capabilities provided by Buyatab.com, affiliates of Buyatab.com and
other third parties.
Equipment
User shall be responsible for obtaining and maintaining all telephone, computer
hardware and other equipment needed for access to and use of this Site and all
charges related thereto. Buyatab.com shall not be liable for any damage to
User's equipment resulting from use of this Site.
User Conduct
This Site and any Registered Merchant now or hereinafter contained within or
otherwise available through external hyperlinks with Buyatab.com’s Site are
private property. All interactions on this Site and/or the Registered Merchants
must comply with these Terms. Although Buyatab.com welcomes and encourages user
interaction on Buyatab.com’s Site, User shall restrict any and all activity in
connection with the use of this Site and the Registered Merchants to that which
involves lawful purposes only. User shall not post or transmit through this Site
any material which violates or infringes in any way upon the rights of others,
or any material which is unlawful, threatening, abusive, defamatory, invasive of
privacy or publicity rights, vulgar, obscene, profane or otherwise
objectionable, which encourages conduct that would constitute a criminal
offense, give rise to civil liability or otherwise violate any law, or which,
without Buyatab.com's express prior, written approval, contains advertising or
any solicitation with respect to products or services. Any conduct by User that
in Buyatab.com's exclusive discretion restricts or inhibits any other User from
using or enjoying this Site and/or any of the Registered Merchants is strictly
prohibited. User shall not use this Site or any of the Registered Merchants to
advertise or perform any commercial, religious, political or non-commercial
solicitation, including, but not limited to, the solicitation of users of this
Site and/or the Registered Merchants to become users of other on- or offline
services directly or indirectly competitive or potentially competitive with
Buyatab.com.
The foregoing provisions of this section apply equally to and are for the
benefit of Buyatab.com, its subsidiaries, affiliates and its third party content
providers and licensors, and each shall have the right to assert and enforce
such provisions directly or on its own behalf.
These provisions will survive termination of this agreement.
Monitoring
Buyatab.com shall have the right, but not the obligation, to monitor the content
of the Site at all times, including any chat rooms and forums that may hereafter
be included as part of the Site, to determine compliance with this Agreement and
any operating rules established by Buyatab.com, as well as to satisfy any
applicable law, regulation or authorized government request. Without limiting
the foregoing, Buyatab.com shall have the right to remove any material that
Buyatab.com, in its sole discretion, finds to be in violation of the provisions
hereof or otherwise objectionable.
License Grant
By posting communications on or through this Site, User shall be deemed to have
granted to Buyatab.com a royalty-free, perpetual, irrevocable, non-exclusive
license to use, reproduce, modify, publish, edit, translate, distribute,
perform, and display the communication alone or as part of other works in any
form, media, or technology whether now known or hereafter developed, and to
sublicense such rights through multiple tiers of sublicenses.
Buyatab.com grants User a limited, revocable, and non-exclusive license to
access and make personal use of the site. User shall may not frame or utilize
framing techniques to enclose the site or any portion thereof without
Buyatab.com's prior written consent.
The limited license set forth in this section does not include the right to: (i)
modify or download the site or its contents (except caching); (ii) make any use
of the site or its Content other than personal use; (iii) create any derivative
work based upon either the site or its Content; (iv) collect account information
for the benefit of another party; (v) use any meta tags or any other "hidden
text" utilizing Buyatab.com’s name or the Trademarks without Buyatab.com’s
express written consent; or (vi) use software robots, spiders, crawlers, or
similar data gathering and extraction tools, or take any other action that may
impose an unreasonable burden or load on Buyatab.com’s infrastructure.
Any unauthorized use by User of the site terminates the limited license set
forth in this section. These provisions will survive termination of this
agreement.
User account
User shall maintain the confidentiality of User’s account and password and
appropriately restrict access to User’s computer. User accepts responsibility
for all activities that occur under User’s account or password. If User accesses
or uses the site on someone else's behalf, User represents that User has the
authority to bind that person as principal to all Terms provided herein, and
User accepts liability for harm caused by that person's use of the site.
Buyatab.com reserves the right to refuse service, terminate accounts, remove or
edit content, or cancel User’s account or any orders placed from User’s account
for any reason, in Buyatab.com’s sole discretion.
Indemnification
User agrees to defend, indemnify and hold harmless Buyatab.com, its affiliates
and their respective directors, officers, employees and agents from and against
all claims and expenses, including attorneys' fees, arising out of User’s use of
this site and/or the Registered Merchants.
These provisions will survive termination of this agreement.
Termination
Buyatab.com may terminate this Agreement at any time. Without limiting the
foregoing, Buyatab.com shall have the right to immediately terminate any
passwords or accounts of User in the event of any conduct by User which
Buyatab.com, in its sole discretion, considers to be unacceptable, or in the
event of any breach by User of this Agreement. These provisions will survive
termination of this agreement.
Terms of Tabs, Ordering, Payment and Delivery
Product description
Tabs are available as E-Tabs or as Plastic Tabs. E-Tabs are emailed, mailed or
self printed. Plastic Tabs are mailed directly from the Merchant to the
recipient selected by User. Buyatab.com attempts to be as accurate
as possible when describing products on this site; however, Buyatab.com does not
warrant that product descriptions or other content available on the site are
accurate, complete, reliable, current, or error-free. If a product offered on

Terms for All Tabs

Tabs are prepaid obligations for a Registered Merchant that has agreed with
Buyatab.com to honor the Tab for the full amount. Buyatab.com sells only the
Tab; Buyatab.com is not responsible to ensure any Merchant will honor any Tab.
The Registered Merchant is solely responsible for honoring the Tab; User shall
not make any claim against Buyatab.com in respect of any Tab that Is not honored
by the Merchant.

Tabs are subject to the policies and restrictions imposed by the Registered
Merchant.

Buyatab.com does not warrant or guarantee that any goods or services provided by
Buyatab.com or by any Merchant will satisfy User requirements, or will be
uninterrupted or error free.

Buyatab.com will not provide any refund
if User is not satisfied with goods or services provided by a Merchant, or If User
purchases a Tab for a Registered Merchant that is no longer in business.

Neither Buyatab.com nor any Registered Merchant is responsible for any lost or
stolen Tab

A Tab is valid only at the Registered Merchant stated on the Tab
-
Any attempted redemption not consistent with these terms & conditions will render a
Tab void
-
Reproduction, sale or trade of a Tab is prohibited unless done in compliance with
applicable law
Buyatab.com constantly updates its database of
Registered Merchants and tries to remove Registered Merchants no longer in
business as soon as Buyatab.com is notified.
Terms for E-Tabs

Pre paid Registered Merchant obligations in the form of a printable / emailable Tab

No cash value

No cash back upon redemption or at any other time

Delivery method chosen by User may result in charges as displayed
Terms for Plastic Tabs

Use of Plastic Tabs is subject to the gift card policy of the Registered Merchant
which may contain terms different from those used by Buyatab.com, including
terms as to expiration of any Plastic Tab, cash value, cash back, and cost of
delivery.
Ordering and Payment
Adding Items to Your Cart
Locate the Tab you wish to purchase, select E -Tab or Plastic Tab (if option is
available), enter quantity, and select a denomination.
Enter Delivery Information
Provide the physical address where your Tab will be shipped or an email address
for email delivery. Self Printed Tabs are delivered by the purchaser; therefore
Buyatab.com does not require any delivery information for a Self Printed Tab.
Select a Shipping Method
Consider how quickly your order needs to be received and choose a shipping
method for your order.
Shopping Cart
After reviewing items placed in the cart User can continue shopping or proceed
to checkout. To buy additional Tabs add them to the cart, selecting a delivery
address for each item.
Sign In or Create Account
Once Users proceed to checkout Users will be asked to sign in to Users account.
If Users do not have an account Users will need to create one, or use the Quick
Checkout option.
Billing Information
Next, let us know how Users would like to pay for the order. Buyatab.com accepts
Visa, MasterCard and Amex.
Review and Submit Order
Review the information provided and make changes if necessary. Once User is
satisfied, submit the order. Please make sure to print the page with the Order
Confirmation Receipt for User’s records.

Buyatab.com is not responsible for undelivered Tabs due to incorrect email or
physical address information, or misdirection by user’s selected shipping
carrier (if email or print delivery not selected). If a mailed Tab does not
arrive, Buyatab.com will do its best to locate and track the Tab, but
Buyatab.com is not responsible for undelivered emailed, printed or shipped Tabs.
Tracking Users Order
For Tabs being mailed tracking information will be
provided to the purchaser if available.
Payment
Buyatab.com accepts Visa®, MasterCard®, and Amex. Credit cards accepted are
handled through a third party and Buyatab.com does not keep record of and/or
store any vulnerable credit card information.
Shipping
Orders placed before 2PM EST will follow the delivery time stated below (add one
business day for orders placed after 2PM EST):

Email Tabs will be sent the same day, if requested.

Orders for Plastic Tabs made on legal holidays will be processed and shipped the
following business day and delivered according to the shipping option Users
choose.
Returns
Buyatab.com does not accept any returns or offer any refunds or credit whether
or not a Tab has been used.
Currency
Until further notice, Tabs are available only in Canadian dollars.
Copyright and Trade-marks
Everything located on or in this Site is the exclusive property of Buyatab.com
and can only be used with express permission of the copyright and/or trade-mark
owner. ANY COPYING, DISTRIBUTING, TRANSMITTING, POSTING, LINKING, DEEP LINKING,
OR OTHERWISE MODIFYING OF THIS SITE OR ANY OF THE REGISTERED MERCHANTS WITHOUT
THE EXPRESS WRITTEN PERMISSION OF BUYATAB.COM IS STRICTLY PROHIBITED. Any
violation of this policy may result in a copyright, trade-mark or other
intellectual property right infringement that may subject User to civil and / or
criminal penalties.
This Site contains copyrighted material, trade-marks and other proprietary
information, including, but not limited to, text, software, photos, video,
graphics, music, sound, and the entire contents of Buyatab.com, protected by
copyright under Canadian copyright laws. Buyatab.com owns a copyright in the
selection, coordination, arrangement and enhancement of such content, as well as
in the content original to it. User may not modify, publish, transmit,
participate in the transfer or sale, create derivative works, or in any way
exploit, any of the content, in whole or in part. User may download / print /
save copyrighted material for User's personal use only. Except as otherwise
expressly stated under copyright law, no copying, redistribution,
retransmission, publication or commercial exploitation of downloaded material
without the express permission of Buyatab.com and the copyright owner is
permitted. If copying, redistribution or publication of copyrighted material is
permitted, no changes in or deletion of author attribution, trade-mark legend or
copyright notice shall be made. User acknowledges that he/she/it does not
acquire any ownership rights by downloading copyrighted material. trade-marks
that are located within or on the Site or a Web site otherwise owned or operated

but rather the exclusive property of Buyatab.com, unless such site is under

User shall not upload, post or otherwise make available on this Site any
material protected by copyright, trade-mark or other proprietary right without
the express permission of the owner of the copyright, trade-mark or other
proprietary right. Buyatab.com does not have any express burden or
responsibility to provide User with indications, markings or anything else that
may aid User in determining whether the material in question is copyrighted or
trade-marked. User shall be solely liable for any damage resulting from any
infringement of copyrights, trade-marks, proprietary rights or any other harm
resulting from such a submission. By submitting material to any public area of
this Site, User warrants that the owner of such material has expressly granted
Buyatab.com the royalty-free, perpetual, irrevocable, non-exclusive right and
license to use, reproduce, modify, adapt, publish, translate and distribute such
material (in whole or in part) worldwide and/or to incorporate it in other works
in any form, media or technology now known or hereafter developed for the full
term of any copyright that may exist in such material. User also permits any
other User to access, view, store or reproduce the material for that User's

Disclaimer of Warranty; Limitation of Liability
The site is presented "AS IS." Buyatab.com does not make any representation or
warranty of any kind whatsoever, express or implied, in connection with these
Terms, the site, the Tabs, or any Registered Merchant or its products or
services, including but not limited to warranties of merchantability or fitness
for a particular purpose.
User agrees that Buyatab.com will not be liable, under any circumstances, for
any (a) interruption of business; (b) access delays or access interruptions to
this site; (c) data non-delivery, misdelivery, corruption, destruction or other
modification, (d) adverse reactions to foods or beverages consumed by User, or
items with which User comes in contact while using or attempting to use a Tab;
(e) events which occur while any person is under the influence of alcohol
purchased with a Tab; (f) failure of a Merchant to honor a Tab; (g) any policy
of a Merchant that prevents User from obtaining full use or enjoyment of a Tab;
(h) discriminatory application by any Merchant of rules or policies to users of
Tabs; (i) late delivery or non-delivery of Tabs as ordered; (j) any other claim,
loss, cost, liability, damage or expense of any kind whatsoever incurred by User
as a result of using this site or any Tab; or (k) events beyond Buyatab.com’s
reasonable control.
Buyatab.com will not be liable for any indirect, special, incidental, or
consequential damages of any kind (including lost profits), regardless of the
form of action whether in contract, tort (including negligence), or otherwise,
even if Buyatab.com, has been advised of the possibility of such damages.
USER AGREES THAT USE OF THIS SITE, THE TABS, AND THE REGISTERED MERCHANTS IS AT
USER'S SOLE RISK. NEITHER BUYATAB.COM, ITS AFFILIATES NOR ANY OF THEIR
RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTENT PROVIDERS OR
LICENSORS WARRANT THAT USE OF THE SITE WILL BE UNINTERRUPTED OR ERROR FREE; NOR
DO THEY MAKE ANY WARRANTY AS TO (I) THE RESULTS THAT MAY BE OBTAINED FROM USE OF

FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY
IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT
OR DESTRUCTION OR UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF RECORD,
WHETHER FOR BREACH OF CONTRACT, TORTIOUS BEHAVIOR, NEGLIGENCE, OR UNDER ANY
OTHER CAUSE OF ACTION. USER SPECIFICALLY ACKNOWLEDGES THAT BUYATAB.COM IS NOT
LIABLE FOR THE DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR
THIRD-PARTIES AND THAT THE RISK OF INJURY FROM THE FOREGOING RESTS ENTIRELY WITH
USER.
IN NO EVENT SHALL BUYATAB.COM, OR ANY PERSON OR ENTITY INVOLVED IN CREATING,
PRODUCING OR DISTRIBUTING THIS SITE OR THE CONTENTS HEREOF, INCLUDING THE
REGISTERED MERCHANTS AND ANY SOFTWARE, BE LIABLE FOR ANY DAMAGES, INCLUDING,
WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR
PUNITIVE DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THIS SITE. USER
HEREBY ACKNOWLEDGES THAT THE PROVISIONS OF THIS SECTION SHALL APPLY TO ALL
CONTENT ON THIS SITE AND THE REGISTERED MERCHANTS.
NEITHER BUYATAB.COM, NOR ITS AFFILIATES, INFORMATION PROVIDERS OR CONTENT
PARTNERS SHALL BE LIABLE REGARDLESS OF THE CAUSE OR DURATION, FOR ANY ERRORS,
INACCURACIES, OMISSIONS, OR OTHER DEFECTS IN, OR UNTIMELINESS OR UNAUTHENTICITY
OF, THE INFORMATION CONTAINED WITHIN THIS SITE OR ANY OF THE REGISTERED
MERCHANTS, OR FOR ANY DELAY OR INTERRUPTION IN THE TRANSMISSION THEREOF TO THE
USER, OR FOR ANY CLAIMS OR LOSSES ARISING THEREFROM OR OCCASIONED THEREBY. NONE
OF THE FOREGOING PARTIES SHALL BE LIABLE FOR ANY THIRD-PARTY CLAIMS OR LOSSES OF
ANY NATURE, INCLUDING WITHOUT LIMITATION LOST PROFITS, PUNITIVE OR CONSEQUENTIAL
DAMAGES.
BUYATAB.COM IS NOT RESPONSIBLE FOR ANY CONTENT THAT A USER, SUBSCRIBER, OR AN
UNAUTHORIZED USER MAY POST ON THIS SITE OR ANY OF THE REGISTERED MERCHANTS. ANY
CONTENT THAT IS POSTED OR UPLOADED THAT IS OR MAY BE DEEMED UNSUITABLE CAN AND
MAY BE TAKEN DOWN BY BUYATAB.COM. MOREOVER, BUYATAB.COM RESERVES THE RIGHT TO
EDIT, CHANGE, ALTER, DELETE AND PROHIBIT ANY AND ALL CONTENT THAT IT,
BUYATAB.COM, DEEMS UNSUITABLE.
These provisions will survive termination of this agreement.
Third party content
Buyatab.com, similar to an Internet Service Provider, is a distributor (and not
a publisher) of content supplied by third parties and Users. Accordingly,
Buyatab.com has no more editorial control over such content than does a public
library, bookstore or newsstand. Any opinions, advice, statements, services,
offers, or other information or content expressed or made available by third
parties, including information providers, or any other Users are those of the
respective author(s) or distributors) and not of Buyatab.com. Neither
Buyatab.com nor any third-party provider of information guarantees the accuracy,
completeness, or usefulness of any content, nor its merchantability or fitness
for any particular purpose.
In many instances, the content available through this Site represents the
opinions and judgments of the respective information provider, User, or other
user not under contract with Buyatab.com. Buyatab.com neither endorses nor is
responsible for the accuracy or reliability of any opinion, advice, or statement
made on Buyatab.com by anyone other than authorized Buyatab.com employee
spokespersons while acting in official capacities. Under no circumstances will
Buyatab.com be liable for any loss or damage caused by an User's reliance on
information obtained through Buyatab.com. It is the responsibility of User to
evaluate the accuracy, completeness, or usefulness of any information, opinion,
advice, etc., or other content available through Buyatab.com.
Buyatab.com contains links to third party Web sites maintained by other content
providers. These links are provided solely as a convenience to Users and not as
an endorsement by Buyatab.com of the contents on such third-party sites and
Buyatab.com hereby expressly disclaims any representations regarding the content
or accuracy of materials on such third-party Web sites. If User decides to
access linked third-party Web sites, User does so at its own risk. Unless Users
have executed a written agreement with Buyatab.com expressly permitting Users to
do so, Users may not provide a hyperlink to the Site from any other website.
Buyatab.com reserves the right to revoke its consent to any link at any time in
its sole discretion.
Unsolicited idea submission
Users acknowledge and agree that Buyatab.com is free to use any unsolicited
ideas, concepts or know-how submitted by Users for any purpose whatsoever
including, but not limited to developing, manufacturing, distributing and
marketing products using such information, without compensation to Users.
Children
If User is under 13, User should not use Buyatab.com and should consult User’s
parent.
Intellectual property
All content and technology available on or underlying the site, such as but not
limited to text, graphics, logos, button icons, images, audio clips, data
compilations, and software is the property of Buyatab.com, and is protected by
Canadian and International copyright laws. The compilation of all content on
this site is the exclusive property of Buyatab.com and protected by Canadian and
international copyright laws.
The trademarks, logos, and service marks displayed on the site (collectively the
"Trademarks") are the registered and unregistered marks of Buyatab.com, except
trademarks that are the property of their respective owners, who may or may not
be affiliated with, connected to, or sponsored by Buyatab.com.
Neither the site, the Trademarks, nor any portion of the site may be reproduced,
duplicated, copied, sold, resold, or otherwise exploited for any purpose without
the prior written consent of Buyatab.com.
Additional Terms for All Buyatab.com Products
By purchasing a Tab, User acquires the right to either print, email or mail that
Tab. Whether User chooses to ship the Tab or to use the Tab is at User’s sole
discretion.
Miscellaneous Matters
This Agreement will be governed by, and construed and enforced in accordance
with the laws of British Columbia.
In any action relating to Users access to or use of this site or any third-party
